These terms govern payments and cancellations for bookings made directly through https://escapadasencatalunya.com/ for the accommodation identified in the booking confirmation.
Before completing the booking, guests will be able to review the price of their stay, the required advance payment and the applicable terms.
1. Accommodation operator and contact details
The booking contract is entered into with the operator responsible for the accommodation:
- Operator: Berta Portet Casals.
- NIF (Spanish tax identification number): 47853485F.
- Operator’s address: Calle Teodora Lamadrid 48 Local, 08022 Barcelona (Barcelona), Spain.
- Email: reservas@escapadasencatalunya.com.
- Telephone: +34 689 245 224.
- Website: https://escapadasencatalunya.com/
Enquiries about payments, changes and cancellations may be submitted through the contact channels listed above.
2. Booking price
The price for the selected dates and booking details will be displayed before the booking is completed.
Applicable taxes and mandatory charges will be identified during the booking process. If any tax must be paid separately, guests will be informed in advance of its amount or how it is calculated, and when payment is due.
Optional services will only be included in the price if requested by the guest.
Rates may vary for new bookings. Subsequent price changes will not affect the amount of an already confirmed booking, unless the guest requests a change and expressly accepts the new price.
3. Advance payment when booking
An advance payment equivalent to the price of one night will be required when booking. The exact amount will be displayed before payment and recorded in the booking confirmation.
This advance payment forms part of the total price of the stay and will be deducted from the outstanding balance. It is neither a security deposit for damage nor an additional accommodation charge.
The booking will be confirmed once the booking process has been successfully completed and the corresponding confirmation has been issued. If a payment issue occurs, the guest must contact the accommodation to check the status of their booking.
4. Payment of the outstanding balance
The remaining amount must be paid no later than 48 hours before the check-in time stated in the booking confirmation.
The confirmation will specify the outstanding amount and its payment deadline. The accommodation will provide the instructions or link needed to complete payment.
Sending a reminder does not change the agreed payment deadline. If the guest does not receive the link or has difficulty paying, they must contact the accommodation to arrange an alternative payment method.
For bookings made 48 hours or less before check-in, full payment will be required at the time of booking.
5. Payment methods and subsequent charges
Available payment methods will be displayed during the booking process. Card payments will be processed through the payment gateway enabled on the website.
If guests are offered the option of saving a payment method to pay the balance later, they will be informed and the necessary authorisation will be requested. Accepting these terms does not authorise charges other than those relating to the amounts and items previously agreed.
If the bank requires additional authentication or a charge cannot be completed, instructions will be provided so that the guest can make the payment.
Guests will not be asked to send full card numbers or security codes by email or messaging services.
6. Payment issues and non-payment
If the balance is not paid by the agreed deadline, the accommodation will contact the guest to explain the issue and help resolve it.
Before terminating the booking for non-payment, the guest will be notified of the outstanding amount and given a reasonable period to make payment, taking into account how soon check-in is due.
If non-payment continues and termination of the booking is appropriate, the guest will be expressly notified. The financial settlement will comply with these terms and applicable legislation, without imposing multiple penalties for the same reason.
7. Cancellation by the guest
Guests may cancel their booking by writing to reservas@escapadasencatalunya.com or notifying the accommodation through the other contact channels listed.
Guests are advised to provide the name of the person who made the booking, the booking reference and the dates of the stay. The notification date will be the date evidenced by the communication channel used; it will not depend on when the accommodation responds.
For voluntary cancellations by the guest, an amount equivalent to the one-night advance payment stated in the confirmation will be retained, regardless of how far in advance the cancellation is communicated, subject to the exceptions in these terms and any rights granted by applicable legislation.
If only the advance payment has been made, there will be no additional amount to refund.
If the full price or any amount exceeding the advance payment has been paid, the difference will be refunded, with only the price of one night retained.
Cancellation will not result in the remaining cost of the stay being charged as an additional penalty.
8. Changes to the booking
Changes to dates, length of stay or occupancy must be requested from the accommodation and are subject to availability.
Before a change is accepted, its effect on the price and payments already made will be communicated. The change will only be confirmed once both parties have accepted it.
Requesting a change does not, in itself, cancel the original booking. If the requested change cannot be made, the guest may keep the booking or cancel it in accordance with the policy above.
9. Cancellation by the accommodation
If the accommodation cannot provide the booked stay, it will notify the guest as soon as possible and refund in full the amounts paid for services that cannot be provided.
If the cancellation results from a decision by the accommodation or a cause attributable to it, the guest will also be entitled to compensation equivalent to the price of one night, without prejudice to any other rights available under the law.
Alternative dates or accommodation may be offered, but acceptance will be voluntary. A refund will not be conditional on accepting a voucher or an alternative arrangement.
10. Force majeure and statutory rights
Situations involving force majeure or a legal inability to provide the stay will be assessed according to the specific circumstances and applicable legislation.
Guests may provide relevant documentation to support their request, while avoiding the disclosure of unnecessary personal data.
The one-night retention will not apply where there is a statutory right to a full refund. This policy will not be used to limit the guest’s rights in the event of a breach of obligations by the accommodation.
11. Processing refunds
When a refund is due, the accommodation will communicate the amount to be refunded and, where applicable, the amount retained under these terms.
The refund will be processed without unjustified delay and, as a commitment by the accommodation, within 14 calendar days following notification of a cancellation that entitles the guest to a refund.
The same payment method used for the booking will be used for the refund, unless another method is agreed with the guest that does not incur additional costs for them.
The date on which the refund appears in the account may depend on the financial institution. No additional administration fees will be deducted from the refund provided for under this policy.
12. Invoicing
The accommodation will issue the appropriate invoice or supporting document in accordance with applicable legislation.
Guests may provide their billing details during booking or send them to reservas@escapadasencatalunya.com. If an invoice is required in the name of a company or another person, the necessary details must be provided.
Where an advance payment needs to be documented, invoicing for the stay completed or a transaction adjusted following a refund, the corresponding document will be issued.
Electronic invoices will be provided with the recipient’s consent, without preventing them from obtaining a paper invoice where applicable.
13. Right of withdrawal
Tourist accommodation bookings for specific dates or periods are exempt from the general 14-day right of withdrawal under Article 103(l) of Spanish Royal Legislative Decree 1/2007.
This exemption does not prevent cancellation under the agreed policy or limit any rights arising from a breach of contract.
14. Acceptance and retention of the terms
Before completing the booking, guests will have access to these terms and must accept them by ticking the designated checkbox.
The confirmation will include the essential booking details, and a copy of the applicable terms will be provided in a format that can be retained.
Subsequent changes to this page will apply to new bookings. They will not alter the terms of earlier bookings without the guest’s agreement.
15. Enquiries and complaints
Enquiries and complaints may be addressed to:
- Email: reservas@escapadasencatalunya.com.
- Telephone: +34 689 245 224.
- Postal address: Berta Portet Casals, Calle Teodora Lamadrid 48 Local, 08022 Barcelona (Barcelona), Spain.
The accommodation will make the applicable official complaint forms available.
These terms will be applied in accordance with consumer protection legislation and the guest’s rights that cannot be waived. Any dispute will be submitted to the competent authorities or courts as determined by law, without requiring consumers to waive the jurisdiction to which they are legally entitled.
16. Bookings through other platforms
This policy applies to direct bookings made on escapadasencatalunya.com.
Bookings made through external platforms will be governed by the terms communicated and accepted through the relevant booking channel.
